virtue of the powers granted by its Constitutive Statute.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-1e41ba6 elementor-widget Mediadores, Conciliadores, \u00c1rbitros, Secretarios y Peritos<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-0e68884 elementor-widget elementor-widget-text-editor\" data-id=\"0e68884\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>El presente C\u00f3digo de \u00c9tica ser\u00e1 aplicable tanto a Mediadores, Conciliadores, \u00c1rbitros, Secretarios y Peritos que participen en los procesos administrados por CESCON. El C\u00f3digo de \u00c9tica establece las normas y principios que en su actuar deben seguir las personas que desempe\u00f1an los cargos mencionados.<\/p><p><strong>Art\u00edculo 1. \u00c9tica<\/strong><\/p><p>En el Centro, los \u00e1rbitros, mediadores, conciliadores y secretarios deber\u00e1n comportarse en el ejercicio del cargo profesional asumido, bajo las m\u00e1s estrictas normas \u00e9ticas de conducta. En este sentido, deben actuar fundados en los principios de igualdad, justicia y respeto a la ley.<\/p><p><strong>Art\u00edculo 2. Transparencia y Diligencia<\/strong><\/p><p>Los \u00e1rbitros, mediadores, conciliadores y secretarios asumen un compromiso profesional con las partes, con su profesi\u00f3n y con la sociedad. En este cometido, deben actuar de manera transparente con las partes involucradas, ser honestos e imparciales, diligentes y atentos en el desempe\u00f1o del trabajo, y asegurar no tener un inter\u00e9s propio en el acuerdo y\/o laudo que profieran.<\/p><p><strong>Art\u00edculo 3. Imparcialidad<\/strong><\/p><p>Es deber de los \u00e1rbitros, mediadores y conciliadores mantener una conducta imparcial y equilibrada respecto de las partes, de los asuntos y cuestiones planteadas. En consecuencia, no podr\u00e1n adoptar posturas que manifiesten un inter\u00e9s personal en el caso asignado o cualquier inter\u00e9s frente al asunto que es materia de conflicto. S\u00ed en cualquier momento los \u00e1rbitros, mediadores o conciliadores no pudiesen dirigir el proceso en la forma y modo mencionado, deber\u00e1n de inmediato renunciar al cargo.<\/p><p><strong>Art\u00edculo 4. Conflicto de Inter\u00e9s<\/strong><\/p><p>Es obligaci\u00f3n de los \u00e1rbitros, mediadores y conciliadores revelar todo y cualquier conflicto de inter\u00e9s real o potencial de cualquier naturaleza, como haber actuado para cualquiera de las partes como asesor legal, consejero, \u00e1rbitro, juez, fiscal, testigo o en cualquier otro papel, as\u00ed como cualquier otra circunstancia que indique un conflicto de inter\u00e9s que pueda restarle neutralidad o imparcialidad con respecto al caso.<br \/>Los \u00e1rbitros, mediadores y conciliadores deben en todo momento actuar de manera diligente en la cuesti\u00f3n a fin de demostrar un esfuerzo razonable para determinar s\u00ed existe o no un conflicto de inter\u00e9s. Si existiere, los \u00e1rbitros, mediadores y conciliadores renunciar\u00e1n al proceso, salvo el consentimiento expreso de todas las partes a la participaci\u00f3n de los mismos.<br \/>La obligaci\u00f3n de revelar un conflicto de inter\u00e9s se mantendr\u00e1 durante todo el proceso.<\/p><p><strong>Art\u00edculo 5. Prohibici\u00f3n<\/strong><\/p><p>Est\u00e1 absolutamente prohibido a los \u00e1rbitros, mediadores y conciliadores, recibir de una de las partes sin presencia de la otra, ninguna informaci\u00f3n, datos o documentos de naturaleza alguna, ni emitir parecer que pueda afectar directa o indirectamente el derecho de alguna de las partes, salvo que la otra haya sido debidamente notificada y su ausencia no se encuentre justificada.<\/p><p><strong>Art\u00edculo 6. Prohibici\u00f3n de Asesorar<\/strong><\/p><p>Queda prohibido a los \u00e1rbitros, mediadores y conciliadores actuar en el futuro como representantes, asesores o consultores de cualquiera de las partes en el caso en que hubieran actuado como \u00e1rbitros o mediadores, as\u00ed como en controversias sustancialmente relacionadas con el mismo, salvo que obtengan la autorizaci\u00f3n por escrito de todas las partes en cuesti\u00f3n.<\/p><p><strong>Art\u00edculo 7. Prohibici\u00f3n de Informar<\/strong><\/p><p>Queda prohibido a los \u00e1rbitros, mediadores y conciliadores, por el motivo que fuere informar a terceros sobre el desarrollo del proceso sometido a mediaci\u00f3n, arbitraje o conciliaci\u00f3n y se obligan a mantener la confidencialidad del caso, salvo en aquellos casos en que la ley lo obligue o sea requerido por una autoridad judicial.<\/p><p><strong>Art\u00edculo 8. Intereses No Representados<\/strong><\/p><p>Cuando los \u00e1rbitros, mediadores y conciliadores adviertan que existen intereses no presentes ni representados en la mediaci\u00f3n, conciliaci\u00f3n o en el proceso arbitral y que las partes no han considerado y que pudieran resultar afectados por la transacci\u00f3n o laudo, deber\u00e1n hacerlo saber a las partes y sugerir la integraci\u00f3n del procedimiento con dichos terceros.<\/p><p>Los mediadores y conciliadores deben poner el mejor esfuerzo para informar a las partes de los efectos precisos, claros y concluyentes de la transacci\u00f3n, inclusive sobre los derechos que renuncian y aquellos que se comprometen a no reclamar antes de que suscriba el acta de transacci\u00f3n. De igual manera deber\u00e1n informar, a la parte que est\u00e1 ante la posibilidad de invocar la exigencia de una norma legal que le proteja, la forma de aplicaci\u00f3n de la misma. Esta obligaci\u00f3n, no ser\u00e1 exigible en relaci\u00f3n con aquellos mediadores y conciliadores que no sean abogados.<\/p><p><strong>Art\u00edculo 9. Aceptaci\u00f3n del Cargo<\/strong><\/p><p>Una vez aceptado el encargo de \u00e1rbitro, mediador, conciliador o secretario el cumplimiento de las funciones es obligatorio, y no podr\u00e1n renunciar al cargo bajo el pretexto de actividades distintas, salvo inter\u00e9s en el caso y\/o fuerza mayor debidamente justificada. Es fundamental que los \u00e1rbitros, mediadores y conciliadores cumplan y hagan cumplir los plazos del procedimiento que corresponda para la substanciaci\u00f3n del caso que les sea encomendado.<\/p><p><strong>Art\u00edculo 10.
